AGREEMENT TO OUR LEGAL TERMS
We are PRB Photo ("Company," "we," "us," "our").
We provide photography services and operate a website (the "Site"), along with related services including photography sessions, digital galleries, contracts, and client communications (collectively, the "Services").

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and PRB Photo, concerning your access to and use of the Services.
By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by these Legal Terms. If you do not agree with all of these Legal Terms, you are prohibited from using the Services.
We reserve the right to update or modify these Legal Terms at any time. Updates will be reflected by revising the "Last updated" date above. Continued use of the Services after changes are posted constitutes acceptance of those changes.
The Services are intended for individuals who are at least 18 years old.
1. OUR SERVICES
PRB Photo provides professional photography services, which may include but are not limited to:
Portrait sessions
Wedding or event photography
Lifestyle, family, maternity, or engagement sessions
Digital gallery delivery
Print sales
Online booking and contracts
Our Services are not tailored to comply with industry-specific regulations such as HIPAA, FISMA, or similar frameworks. You agree not to use the Services in violation of any applicable law.
2. INTELLECTUAL PROPERTY RIGHTS
Ownership
We are the owner or licensee of all intellectual property rights in our Services, including but not limited to:
Photographs
Edited images
Website content
Logos, branding elements, and graphics
Text and design
All photographs created by PRB Photo remain the copyrighted property of PRB Photo unless otherwise stated in a written agreement.
Images are protected by United States copyright law. Clients are granted a limited license to use delivered images for personal, non-commercial use unless otherwise specified in writing.
Restrictions
You may not:
Copy, alter, sell, or redistribute images for commercial purposes without written permission
Apply filters or edits that alter the integrity of the work
Remove watermarks (if applicable)

3. USER REPRESENTATIONS
By using the Services, you represent that:
You have the legal capacity to agree to these Legal Terms.
You are at least 18 years old.
Any information you provide is accurate and complete.
You will not use the Services for unlawful purposes.
4. PROHIBITED ACTIVITIES
You agree not to:
Use the Services for fraudulent or unlawful purposes
Attempt to copy, download, or distribute images without authorization
Interfere with website functionality
Harass or threaten the Company or other users
Misrepresent PRB Photo’s work as your own
5. CLIENT CONTENT & RELEASES
If you provide PRB Photo with images, inspiration photos, written content, or other materials ("Client Content"), you represent that:
You have the legal right to share such materials
You have obtained necessary permissions from identifiable individuals where required
You grant PRB Photo permission to use Client Content as necessary to provide Services.
6. MODEL RELEASE & IMAGE USE
Unless otherwise agreed upon in writing, PRB Photo may use photographs from sessions for:
Portfolio display
Website use
Social media
Marketing and promotional materials
If you require privacy or confidentiality, you must communicate this in writing prior to or at the time of booking.
7. THIRD-PARTY SERVICES
The Services may include links to third-party platforms such as:
Online gallery hosting services
Payment processors
Contract software providers
We are not responsible for third-party websites, policies, or content. Use of such services is at your own risk and subject to their respective terms.
8. PRIVACY POLICY
We care about data privacy and security. Please review our Privacy Policy available on our website. By using the Services, you agree to be bound by our Privacy Policy.
The Services are hosted in the United States. If you access the Services from outside the United States, you consent to the transfer and processing of your data in the United States.
9. TERM AND TERMINATION
These Legal Terms remain in effect while you use the Services.
We reserve the right to deny access to the Services for violation of these Legal Terms or applicable law. We may terminate or suspend Services at our discretion.
10. MODIFICATIONS AND INTERRUPTIONS

Before initiating formal legal action, both parties agree to attempt to resolve disputes informally for at least thirty (30) days through written communication.
Arbitration
If disputes cannot be resolved informally, they may be resolved through binding arbitration in Arizona under applicable arbitration rules.
Nothing prevents either party from seeking injunctive relief to protect intellectual property rights.
13. DISCLAIMER
The Services are provided on an "as-is" and "as-available" basis. We make no guarantees regarding:
Specific artistic outcomes
Subject appearance or expressions
Weather conditions
Venue limitations
Acts of God or circumstances beyond our control
Photography is subjective in nature, and final images are delivered at the sole artistic discretion of PRB Photo.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, PRB Photo shall not be liable for indirect, incidental, or consequential damages arising from use of the Services.
In any event, liability shall not exceed the total amount paid by you to PRB Photo within six (6) months preceding the claim.
15. INDEMNIFICATION
You agree to indemnify and hold PRB Photo harmless from any claims, damages, or expenses resulting from:
Your misuse of the Services
Your violation of these Legal Terms
Your violation of third-party rights
16. ELECTRONIC COMMUNICATIONS
By using the Services, sending emails, or signing digital contracts, you consent to electronic communications and electronic signatures.
17. CALIFORNIA USERS
California residents may contact the California Department of Consumer Affairs for unresolved complaints.
18. MISCELLANEOUS
These Legal Terms constitute the entire agreement between you and PRB Photo regarding the Services. If any provision is found unenforceable, the remaining provisions remain valid.
Failure to enforce any provision shall not constitute a waiver.
